These general terms and conditions of sale are entered into between COQ AU VIN, a simplified joint-stock company (S.A.S.) with capital of €15,000, located at C/O WEFORGE, 25 rue Lenepveu, 49100 Angers, FRANCE, registered with the Angers Trade and Companies Register under SIREN number 827757972, hereinafter referred to as “COQ AU VIN,” and any individual or legal entity wishing to make a purchase via the CAAAAAAAT website, hereinafter referred to as “the Client.”

A Professional Client, for the purposes of these T&Cs, refers to any client (individual or company) registered in the trade or crafts register, who makes purchases not intended for resale within a commercial or professional activity. This type of Client is treated as a non-professional under the French Consumer Code. The Professional Client agrees not to resell any products purchased on caaaaaaat.com.

Contract Purpose

These terms aim to define the contractual relationship between COQ AU VIN and the Client and the applicable terms for any purchase made through the CAAAAAAAT online store. Making a purchase via this site implies unreserved acceptance of these terms and conditions.

Legal Information

COQ AU VIN collects personal data about the purchaser and, where applicable, the recipient of the order. These data are necessary for processing your order and are intended for COQ AU VIN services. Personal data are processed in accordance with the French Data Protection Act (Law No. 78-17 of January 6, 1978) and the EU GDPR (Regulation 2016/679).

You have rights to access, modify, update, delete or object to the use of your data. You also have the right to restrict processing and to data portability.

Product Characteristics

Products listed on caaaaaaat.com are available within the limits of stock. Each item includes a description. Photos aim to be as accurate as possible but may not be an exact match.

Prices

Prices are shown in euros, including VAT. Any changes to VAT rates may impact prices. COQ AU VIN reserves the right to change prices at any time. The price on the order date is the only applicable one. Prices do not include shipping or handling. Prices apply only within mainland France.

Shipping, customs duties, and formalities are the Client’s responsibility.

Orders

Orders are placed via www.caaaaaaat.com and follow this process:

A confirmation email is sent upon completion. Clients may review their order details and total cost at any point during the process.

Ownership is retained by COQ AU VIN until full payment is received. COQ AU VIN reserves the right to cancel or refuse an order in cases of unresolved disputes or lack of legal capacity.

Orders are fulfilled subject to stock availability.

Payment Terms

Payments are made by credit card.

Order Verification

To prevent online fraud, COQ AU VIN may verify order details before dispatch.

In compliance with French law (Article L 3342-1 of the Public Health Code), alcohol may not be sold to anyone under 18. Clients confirm they are of legal age when ordering. COQ AU VIN may request proof of age. Failure to provide it will result in cancellation.

Orders may be refused if there is a legitimate suspicion of fraud.

Shipping and Delivery

Indicative delivery time in France: 48h to 10 business days.

Orders placed and paid before 6:00 PM (Mon–Fri, excluding holidays) are prepared and shipped the next morning, subject to payment verification.

Clients have 30 business days from the shipping date to report non-receipt and request cancellation or refund.

Any issues with delivery must be reported within 3 business days of receipt.

Force Majeure

COQ AU VIN is not liable for non-performance caused by:

Indirect Damages

In the event of non-fulfillment, COQ AU VIN is only liable for delivery refunds. Indirect damages (e.g., lost profits, revenue, or business) are excluded.

Shipping Damage

If bottles are broken during shipping, the recipient must refuse the delivery. COQ AU VIN will resend the order upon notification. No refunds will be issued.

Right of Withdrawal

Non-professional individuals have a 14-day right of withdrawal from delivery to request a return or refund without penalty. Return shipping is the Client’s responsibility. Refunds are processed within 14 days of withdrawal confirmation.

Returns and Exchanges

Returned items must be unopened, intact, and suitable for resale. Clients cover return shipping and must retain proof of shipment.

Liability

COQ AU VIN is not liable for failure to fulfill an order due to out-of-stock items, force majeure, or events beyond its control (strikes, natural disasters, etc.).

Electronic Signature

Confirmation via the site constitutes an electronic signature with the same legal value as a handwritten one.

Proof

Digital records stored by COQ AU VIN will serve as proof of communications, orders, and payments.

Dispute Resolution

These terms are governed by French law. In case of dispute, clients are encouraged to seek an amicable solution with Customer Service. Failing this, French courts shall have jurisdiction.

Legal Warranties

Products sold are covered by legal warranties. To exercise this right, Clients must notify COQ AU VIN by registered mail.

Refunds or replacements will be made once the defective item is returned. Refunds will use the original payment method.

Note: Wine is a living product and must be stored properly (temperature, light, humidity, no exposure to harmful substances). Failure to meet these conditions voids COQ AU VIN’s liability.

Under Article L.217-9 of the French Consumer Code, the Client may choose between repair or replacement, subject to cost considerations.
